What do the new Labour Codes mean for construction contractors?
Since 21 November 2025, four Labour Codes have replaced about 29 older labour laws, including the Contract Labour Act and the BOCW regime. For contractors, the biggest changes are a wider definition of "wages", a single contractor licence, new attendance and wage registers, and stricter wage-payment deadlines on central government work, with debarment of up to three years for defaulters.
What changed, and when
| Date | What happened | Why contractors care |
|---|---|---|
| 21 Nov 2025 | All four Labour Codes take effect (EY alert) | Old Acts such as the Contract Labour Act are replaced |
| 8 May 2026 | Final Central Rules notified under all four Codes (BDO) | Forms for registers, licence and returns |
| 8 May 2026 | Finance Ministry office memorandum on wage payment by contractors on central government work (StudyCafe report) | Deadlines, and debarment of up to 3 years |
| 8 May 2026 | Building-work cess fixed at 1% under the Code on Social Security | See the BOCW cess calculator |
Wage-payment deadlines on government work
As reported, the 8 May 2026 memorandum asks central ministries, departments and CPSEs to make sure their contractors pay workers on time:
| Wage period | Pay by |
|---|---|
| Daily | End of the shift |
| Weekly | Before the weekly holiday |
| Fortnightly | Within 2 days of the period ending |
| Monthly | Within 7 days of the period ending |
Example: for a monthly wage period ending 31 October, wages are due by 7 November. Contractors who default can reportedly be debarred from bidding for up to three years. The memorandum's own text wasn't available to us, so read your contract's wage clause and any OM attached to your tender.
Whatever the deadline, pay by bank transfer or UPI where you can. It leaves a record that proves you paid on time.
The new "wages" definition and the 50% rule
Under the Code on Wages, "wages" means basic pay, dearness allowance and retaining allowance. Most other allowances are excluded, but only up to 50% of total pay. Anything above that is added back to wages (Lakshmikumaran & Sridharan). Because PF, gratuity and bonus are calculated on wages, a pay structure heavy in allowances costs more under the Codes.
Example: total pay ₹20,000, of which allowances ₹12,000. Half of total pay is ₹10,000, so ₹2,000 is added back and wages become ₹10,000 instead of ₹8,000. Employer PF at 12% rises from ₹960 to ₹1,200 a month, or ₹14,400 a month more across 60 workers. Check PF wage-ceiling treatment with your consultant.
One contractor licence instead of many
The Occupational Safety, Health and Working Conditions (OSH) Code replaced the Contract Labour Act licence. As reported by compliance firms, contractors deploying 50 or more contract workers now need a single licence, valid for five years, applied for online, instead of separate licences per establishment (Lexplosion). State rules decide the details for most sites. Our contractor licence and registration guide covers PWD and CPWD registration too.
Registers you should keep
The central rules prescribe an Attendance Register cum Muster Roll (Form IX) and a Register of Wages, Overtime, Advances, Fines and Deductions (Form IV) (BDO). States may use their own forms. Whatever the format, the data is the same: who was present, how many hours, overtime, advances, deductions and wages paid, and when.
True Site Sync records exactly that data as the site works: daily attendance with half days and overtime, kharchi advances, deductions for lost tools or damaged PPE, bulk wage payments and a monthly muster, plus GPS and photo punch-in for staff. See labour attendance and wages.
When the principal employer pays for your default
Under the Codes, if a contractor fails to pay wages, the principal employer (your client, or you, if you engage subcontractors) can be made to pay and then recover the amount from the contractor (Corporate Professionals). Expect clients to ask for proof of wage payment with every RA bill, and to hold payment if you can't show it. If you engage labour contractors yourself, ask them for the same proof before you release their bills. See subcontractor billing.
Contractor checklist for 2026
- Find out whether your site follows central or state rules, and get the state's forms.
- Check whether you cross 50 contract workers and need the single licence.
- Re-check pay structures against the 50% wage rule, and re-cost PF and ESI.
- Set wage-payment dates that meet the deadlines in your contract.
- Keep attendance and wage records daily, not reconstructed at month-end.
- Pay by bank or UPI, and keep proof ready to attach to every RA bill.
- Ask your labour contractors for the same records before paying them.
Frequently asked questions
When did the new Labour Codes come into force?
All four Labour Codes took effect on 21 November 2025. The final Central Rules were notified in May 2026, and states are notifying their own rules at different speeds.
What are the wage-payment deadlines for contractors in 2026?
As reported, a Finance Ministry memorandum of 8 May 2026 asks central ministries and CPSEs to ensure contractors pay daily wages by the end of the shift, weekly wages before the weekly holiday, fortnightly wages within 2 days and monthly wages within 7 days, with debarment of up to 3 years for defaulters.
Do I still need a Contract Labour Act licence?
The Contract Labour Act has been replaced by the OSH Code. Compliance firms report a single contractor licence for contractors with 50 or more contract workers, valid for five years. Check your state's rules for the exact process.
What is the 50% wage rule?
Wages for PF, gratuity and bonus are basic pay, DA and retaining allowance. Excluded allowances can't exceed 50% of total pay; anything above that is added back to wages.
Is a digital muster roll valid?
The Codes' registers record attendance, hours, overtime, advances, deductions and wages. Electronic registers are widely reported to be allowed, but check your state's rules and keep exports ready for inspection.
Who pays if my labour contractor doesn't pay wages?
The principal employer can be made to pay the unpaid wages and recover them from the contractor. That's why clients increasingly ask for proof of wage payment with RA bills.
Naya labour code thekedar ke liye kya badla?
Mazdoori ki paribhasha badli (50% niyam), 50 se zyada contract mazdoor par ek hi licence, naye register, aur sarkari kaam par mazdoori samay par na dene par 3 saal tak debarment ho sakta hai.
