What is BOCW cess?

BOCW cess is a welfare levy on the cost of building and other construction work, used for construction workers' welfare boards. Under the Code on Social Security, 2020, the rate can be 1–2% of construction cost, and a notification dated 8 May 2026 fixed it at 1%. Land cost is excluded, and the employer pays it in advance on a self-assessment.

What changed in 2026

Worked example

LineWorkingAmount
Construction cost, excluding land₹4,00,00,000
Cess @ 1%₹4,00,00,000 × 1%₹4,00,000
Deduction on an RA bill of ₹50,00,000₹50,00,000 × 1%₹50,000
Over 8 equal RA bills8 × ₹50,000₹4,00,000

On government work, the cess is commonly deducted at source from each RA bill. Over the job, the deductions should add up to the self-assessed total, with any difference trued up at final assessment.

Who pays BOCW cess: owner or contractor?

The law puts the duty on the "employer" of the construction work, which can mean the owner, the contractor, or both, depending on the arrangement. In practice, your tender decides who bears it. For example, a BHEL tender corrigendum of January 2026 makes civil contractors bear the cess within their quoted price (BHEL corrigendum). Price your bid accordingly, and make sure the cess isn't deducted twice, once by the owner and again on your own subcontractors for the same work.

Track cess deductions in True Site Sync

When a client pays you, record the payment with its deductions: TDS, GST-TDS, labour cess (BOCW), retention, penalties and recoveries. Each deduction goes to its own register, so at final assessment you can show exactly how much cess was deducted from which bill. The same works when you pay your own subcontractors. See RA bill software and subcontractor billing.
